In 2022, 155 out of 482 ACOs were granted the SNF waiver through their participation in the MSSP. What's intriguing is that these 155 ACOs demonstrated an average SNF annual per capita expenditure of $701, which stands in contrast to the $814 seen in all other MSSP ACOs. However, an interesting twist emerged in 2022, when the public health emergency led to the 3-midnight rule SNF waiver becoming accessible to all Medicare populations, irrespective of ACO and MSSP status.


While the waiver was made available to all, the key to success lies in refining our operations and workflows to proactively identify patients who meet SNF admission criteria before the three-midnight threshold. The variance in SNF costs is likely attributed to the enhanced coordination of care between SNFs and ACO participants. It's worth noting that when applying for the SNF waiver, an ACO forms a participating SNF network tailored for the MSSP population, always keeping patient choice at the forefront.
